Lock v British Gas – Holiday Pay & Commission

The first instance Judgment in Lock v British Gas is now available. The Employment Tribunal held that a worker with normal working hours whose remuneration included commission shall be deemed to have remuneration which varies for the purpose of s.221 ERA 1996.

An appeal is expected. This is important as whilst the Bear Scotland Judgment dealt with a number of points of principle last year, the method of  calculation for holiday pay remains the subject of debate.
