The guidance relating to damages for injury to feelings has been updated.
Where a Claimant is successful in a claim under the Equality Act (and some other limited claims), the Tribunal will often have the power to make an award in respect of injury to feelings. These are put into categories known as ‘Vento Bands’ after the original case which covered this point.
In respect of claims presented after 6th April 2018, the applicable Vento Bands will be as follows:
Lower Band: £900 to £8600
Middle Band: £8600 to £25,700
Upper Band: £25,700 to £42,900.
The most exceptional cases are capable of exceeding £42,900.
